Our firm has much experience in the practice of real estate litigation and title disputes. This knowledge and experience is helpful in many probate matters where there may be a title dispute involving real estate or a business.
What Is Probate?
Probate is the a procedure by which a person’s estate is reviewed by a court to determine whether a will is valid, or if there is no will, how the assets will be distributed. In the course of a probate proceeding, which usually takes six to nine months, an executor or personal representative may act as guardian of minors, do an inventory of assets, sell unproductive property, pay or compromise claims, and distribute the assets of the estate to beneficiaries, all under the supervision of the court.
Is Probate Necessary?
Only if your loved one did not have a valid living trust. A living trust is an estate planning device that allows property to pass directly to beneficiaries without being delayed by probate. Please see our estate planning page to learn more about this. (Learn more about Estate Planning)
